JUDICIAL REVIEW - WHAT IT MEANS
FOR YOU
In July 1999, Thanet District Council issued a Certificate of Lawfulness for
Manston Airport .
This Certificate means that the change from military to full
civil airport status did not require planning permission.
By issuing this Certificate the Council gave away their powers to control the
development, which could have been done by placing conditions on the planning
consent.
The Manston Airport Group have received legal advice that the issue of the
Certificate may have been unlawful, and so we have decided to challenge it in
the High Court.
This is known as a judicial review.
If we win this case, the Certificate will be revoked and the airport
operators will have to apply for planning permission.
It is likely that a Public
Inquiry will be triggered and the Council will be obliged to attach
environmental controls to the planning consent.
The current position is that we have been given "leave to proceed."
This means that a High Court judge agrees that there is a case to answer.
TDC have consistently refused to order an Environmental Impact Assessment on
the development of Manston.
The aircraft using the airfield are amongst the
noisiest in the world and they are being permitted to fly at low altitude over
high-density residential housing, schools and businesses.
The Council have
consistently signalled that they would be prepared to accept night flights.
If you are concerned that Manston will have a negative effect on your daily
life, that your children's education will be disrupted, or that the value of
your property may be adversely affected, then you are just one of many thousands
of people who share such concerns.
The good news is that you can now do
something about it by helping us to overturn the Certificate which TDC have
granted.
A great deal of work has been invested in reaching a point where local
residents can influence the future of their towns and villages. Please do your
