54 KENT INTERNATIONAL AIRPORT -SECTION 106 AGREEMENT The Council considered the report of the Head of Environmental Services which brought forward a draft Agreement, with a recommendation that it be made the subject of widespread public consultation and engagement. Moved by Councillor Ezekiel, seconded by Councillor J D Kirby, that: "(A) the issues raised in the report be the subject of public consultation and the Chief Executive or his nominee be authorised to prepare appropriate questionnaires and leaflets for the public in consultation with the leader of the Council and the Leader of the Opposition; (B) the public consultation and engagement process as described in Section 2.4 of the report be commenced and completed such that a final version of the Agreement can be returned to Full Council in February 2005; (C) in accordance with Contract Standing Orders, Alan Stratford and Associates, be appointed to advise the Council on the content and format of the Section 106 Agreement; and (D) the sum of £20,000 be identified from within the Planning Delivery Grant, and Planning Fee Income, to fund the engagement of consultancy advice", Amendment moved by Councillor R Nicholson, seconded by Councillor Harrison, that: "(A) on page 4 of Annex 1, the hours defined by the term "night time" be amended to read 2300-0700 hours; (B) on page 15, paragraph 1.2(a) of the second schedule the words "(including the UK)" be removed; and (C) on page 16, paragraph 1.4.2 of the second schedule, the existing wording be removed and replaced with: "Council may agree an additional 12 relief or emergency flights if they agree that some or all extenuating factors apply"". AMENDMENT LOST. Amendment moved by Councillor A Poole, seconded by Councillor D Green, that: "on page 15, paragraph 1.2(a), the following words be added after "on any day": "where the aircraft involved in the operation have a noise classification of Quota Count 4 or less". AMENDMENT LOST. (During the debate, Councillor Ezekiel, with the consent of his seconder, changed the form of words contained with paragraph (8) of the original motion. In order to allow individual Groups to discuss this change, the Chairman adjourned the meeting for a period of 20 minutes). Motion altered by Councillor Ezekiel and agreed by Councillor J D Kirby and the meeting pursuant to Council Procedure Rule 19.7(b), to read that: "(A) the issues raised in the report be the subject of public consultation and the Chief Executive or his nominee be authorised to prepare appropriate questionnaires and leaflets for the public in consultation with the leader of the Council and the Leader of the Opposition; (B) Annex 1 be withdrawn and the existing 106 be the basis for consultation; (C) in accordance with Contract Standing Orders, Alan Stratford and Associates, be appointed to advise the Council on the content and format of the Section 106 Agreement; and (D) the sum of £20,000 be identified from within the Planning Delivery Grant, and Planning Fee Income, to fund the engagement of consultancy advice". SUBSTANTIVE MOTION ADOPTED. |
